Cebu waiter on amicable settlement with Jude Bacalso

Unjust vexation, grave scandal, grave coercion, grave threats, at slight illegal detention ang patung-patong na reklamong inihain ng isang 24-year-old waiter laban sa Cebu-based personality, TV host, at LGBTQIA+ member na si Jude Bacalso sa Cebu Prosecutor’s Office noong Miyerkules, Agosto 28, 2024.

Nagalit si Bacalso nang tawagin siyang “ Sir” ng waiter sa insidenteng nangyari sa Ulli’s Streets Asia restaurant sa Ayala Center, Cebu, noong Hulyo 2024.

Dahil dito, dalawang oras umanong sinermunan at pinatayo ni Bacalso ang complainant.

UPDATE ON CEBU WAITER’S COMPLAINTS AGAINST BACALSO

Nakipag-ugnayan ang PEP.ph (Philippine Entertainment Portal) kay Atty. Ron Ivan Gingoyon, ang legal counsel at spokesperson ng complainant, para alamin ang mga bagong kaganapan buhat nang magsampa sila ng pormal na reklamo sa Cebu Prosecutor’s Office.

Kumusta ang reaksiyon ng publiko sa aksyong ginawa ng kanyang kliyente?

Ayon kay Atty. Gingoyon, “I was not able to pay so much attention, although I have received a number of messages from the media and from family and friends who read or saw the story circulating online.

“Mostly because of the workload I have at the moment, I would be more happy if those who pledged their support, especially financial, will make good of their promises and reach out to our law firm.

“Mahirap yung financial situation ng client ko kasi nawalan siya ng trabaho and wala nang income.”

Ano ang reaksiyon ng kanyang kliyente tungkol sa public support na natatanggap niya?

Tugon ng legal counsel ng waiter, “I have no idea since we do not talk about the public sentiment.

“We are focused only on the merits of the case and how we will move forward with it. Besides, my client has deactivated his social media accounts and is still isolating himself from the public.”

Kumusta na ang kalagayan ng complainant? Sumasailalim ba ito sa therapy dahil sa trauma na kanyang naranasan?

“He is trying to live a normal life,” sabi ni Atty. Gingoyon.

“The trauma is there. We have not yet started the therapy yet since we need the funds.

“It’s one of our demands against Ulli’s since it is their responsibility and they also committed negligence in their failure to provide a safe and healthy working environment to their workers. That is their constitutional and statutory mandated duty.

“We are battling two fronts here: the criminal case against Mr. Jude Bacalso and a labor case against Ulli’s Streets of Asia for their multiple labor standard violations in the payment of wages, working hours, overtime pay, and more.”

Na-terminate o tinanggal ba sa trabaho ang complainant?

Paglilinaw ng abogado, “My client was not terminated by Ulli’s. It was a collective decision from his doctor, lawyers, and family because his old working place is not anymore safe for his mental health due to the trauma caused by Mr. Jude Bacalso.

“There was no support from his former employee. That’s what’s really frustrating. In fact, they even insisted they were not negligent, which is the reason why until now, we have not settled our labor complaints with them.”

COMPLAINANT ALLEGEDLY LIVING IN FEAR

Nang tanungin ng PEP ang pinagkakaabalahan ngayon ng kanyang kliyente, inulit ni Atty. Gingoyon ang sinabi nitong nabubuhay ngayon sa takot ang complainant.

“He’s jobless, he’s afraid, he is in isolation, and all those saying they will help have not really made good of their promises. But there are a few whom I have talked to but nothing concrete and final,” saad ng abogado.

Inihayag ni Atty. Gingoyon na malabo ang posibilidad na amicable settlement sa pagitan ng magkabilang-panig.

“It depends on my client, but right now, he does not want to see, talk, or meet Mr. Jude Bacalso.

“So an amicable settlement would be difficult given the current state of things.

“Mr. Jude Bacalso has never reached out ever since and I doubt if he will ever reach out.”

Nang hingin ng Cabinet Files ang kanyang opinyon tungkol sa kaso na isinampa ng waiter, buo ang paniniwala ni Atty. Gingoyon na makakamit ng kliyente niya ang hustisya.

Ipinarating din niya sa publiko ang kanyang apela na suportahan ang waiter sa kinakaharap nitong laban.

“It will not be up to me, but to the investigating prosecutors. Our justice system is very much working in this part of the country so I trust them,” ani Atty. Gingoyon.

“I would like, again, to appeal to those who want to help my client, whether financially or through a job offer, to please reach out to our law firm at Cabrido and Associates Law Firm.
